答(da) 這樣肯定(ding)是不合(he)法(fa)的,按照《勞(lao)(lao)動(dong)(dong)合(he)同法(fa)》,用(yong)(yong)人(ren)單位不得以(yi)任何借(jie)口扣押勞(lao)(lao)動(dong)(dong)者的財物(wu)。勞(lao)(lao)動(dong)(dong)者的工資在雙方沒有(you)另外約定(ding)的情(qing)況下,用(yong)(yong)人(ren)單位宜按月結算。同時,《勞(lao)(lao)動(dong)(dong)合(he)同法(fa)》還規定(ding)無論勞(lao)(lao)動(dong)(dong)合(he)同是否約定(ding)期限,勞(lao)(lao)動(dong)(dong)者只要提前30日,以(yi)書面形(xing)式(shi)通知(zhi)用(yong)(yong)人(ren)單位,就可以(yi)解除(chu)勞(lao)(lao)動(dong)(dong)合(he)同。如果(guo)是還在試用(yong)(yong)期的話,勞(lao)(lao)動(dong)(dong)者只需提前3天即可。
