用拖欠工資來留住人才,這樣做合法嗎?

答(da) 這(zhe)樣肯(ken)定(ding)是(shi)不(bu)合法的(de),按照《勞(lao)(lao)(lao)動(dong)(dong)(dong)合同法》,用(yong)(yong)(yong)人單位不(bu)得以(yi)(yi)任(ren)何(he)借口扣(kou)押勞(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)的(de)財物。勞(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)的(de)工資在雙方沒有(you)另(ling)外約定(ding)的(de)情況(kuang)下,用(yong)(yong)(yong)人單位宜按月結算。同時,《勞(lao)(lao)(lao)動(dong)(dong)(dong)合同法》還規定(ding)無(wu)論勞(lao)(lao)(lao)動(dong)(dong)(dong)合同是(shi)否約定(ding)期限(xian),勞(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)只要(yao)提(ti)前30日,以(yi)(yi)書面形式通(tong)知用(yong)(yong)(yong)人單位,就可(ke)以(yi)(yi)解除勞(lao)(lao)(lao)動(dong)(dong)(dong)合同。如果(guo)是(shi)還在試用(yong)(yong)(yong)期的(de)話,勞(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)只需(xu)提(ti)前3天(tian)即(ji)可(ke)。
