職工拒簽勞(lao)(lao)動(dong)合同,單(dan)位終止勞(lao)(lao)動(dong)關系,依照法律單(dan)位還需(xu)要給勞(lao)(lao)動(dong)者補償嗎(ma)?

根據《勞(lao)動(dong)(dong)合同法(fa)實(shi)施條例》第5條規定,自(zi)用(yong)工(gong)之日起(qi)一個月(yue)內,經用(yong)人(ren)(ren)單(dan)(dan)位書(shu)面通知(zhi)后,勞(lao)動(dong)(dong)者不與用(yong)人(ren)(ren)單(dan)(dan)位訂立書(shu)面勞(lao)動(dong)(dong)合同的,用(yong)人(ren)(ren)單(dan)(dan)位應(ying)(ying)當書(shu)面通知(zhi)勞(lao)動(dong)(dong)者終止(zhi)勞(lao)動(dong)(dong)關系,無需向(xiang)(xiang)勞(lao)動(dong)(dong)者支付經濟補償(chang),但是應(ying)(ying)當依法(fa)向(xiang)(xiang)勞(lao)動(dong)(dong)者支付其實(shi)際工(gong)作時間(jian)的勞(lao)動(dong)(dong)報(bao)酬。
