離職已經三個月了,可申請仲裁嗎?

我從公司(si)離(li)職(zhi)已經超過三個月了,因為一些問題發(fa)生糾(jiu)紛,還可以申請仲裁嗎(ma)?

離職(zhi)后一(yi)年(nian)內(nei)可以申(shen)(shen)請勞(lao)(lao)動仲(zhong)(zhong)(zhong)(zhong)裁(cai)(cai)(cai)。 《中(zhong)(zhong)華人(ren)(ren)民共(gong)和國勞(lao)(lao)動爭議(yi)(yi)調解仲(zhong)(zhong)(zhong)(zhong)裁(cai)(cai)(cai)法(fa)》第(di)二十(shi)七條(tiao)規(gui)定(ding):“ 勞(lao)(lao)動爭議(yi)(yi)申(shen)(shen)請仲(zhong)(zhong)(zhong)(zhong)裁(cai)(cai)(cai)的(de)時(shi)(shi)(shi)(shi)效(xiao)期(qi)(qi)間(jian)為一(yi)年(nian)。仲(zhong)(zhong)(zhong)(zhong)裁(cai)(cai)(cai)時(shi)(shi)(shi)(shi)效(xiao)期(qi)(qi)間(jian)從(cong)當(dang)(dang)事(shi)人(ren)(ren)知道或(huo)(huo)(huo)者應(ying)當(dang)(dang)知道其權(quan)(quan)利被侵害之日(ri)起(qi)計算。 前款規(gui)定(ding)的(de)仲(zhong)(zhong)(zhong)(zhong)裁(cai)(cai)(cai)時(shi)(shi)(shi)(shi)效(xiao),因(yin)(yin)(yin)當(dang)(dang)事(shi)人(ren)(ren)一(yi)方(fang)向對方(fang)當(dang)(dang)事(shi)人(ren)(ren)主張權(quan)(quan)利,或(huo)(huo)(huo)者向有關部(bu)門請求權(quan)(quan)利救濟,或(huo)(huo)(huo)者對方(fang)當(dang)(dang)事(shi)人(ren)(ren)同意履行義務而中(zhong)(zhong)斷(duan)。從(cong)中(zhong)(zhong)斷(duan)時(shi)(shi)(shi)(shi)起(qi),仲(zhong)(zhong)(zhong)(zhong)裁(cai)(cai)(cai)時(shi)(shi)(shi)(shi)效(xiao)期(qi)(qi)間(jian)重(zhong)新計算。 因(yin)(yin)(yin)不可抗力或(huo)(huo)(huo)者有其他(ta)正當(dang)(dang)理由,當(dang)(dang)事(shi)人(ren)(ren)不能(neng)在(zai)本條(tiao)第(di)一(yi)款規(gui)定(ding)的(de)仲(zhong)(zhong)(zhong)(zhong)裁(cai)(cai)(cai)時(shi)(shi)(shi)(shi)效(xiao)期(qi)(qi)間(jian)申(shen)(shen)請仲(zhong)(zhong)(zhong)(zhong)裁(cai)(cai)(cai)的(de),仲(zhong)(zhong)(zhong)(zhong)裁(cai)(cai)(cai)時(shi)(shi)(shi)(shi)效(xiao)中(zhong)(zhong)止。從(cong)中(zhong)(zhong)止時(shi)(shi)(shi)(shi)效(xiao)的(de)原因(yin)(yin)(yin)消除之日(ri)起(qi),仲(zhong)(zhong)(zhong)(zhong)裁(cai)(cai)(cai)時(shi)(shi)(shi)(shi)效(xiao)期(qi)(qi)間(jian)繼續(xu)(xu)計算。 勞(lao)(lao)動關系存續(xu)(xu)期(qi)(qi)間(jian)因(yin)(yin)(yin)拖欠勞(lao)(lao)動報(bao)酬發生爭議(yi)(yi)的(de),勞(lao)(lao)動者申(shen)(shen)請仲(zhong)(zhong)(zhong)(zhong)裁(cai)(cai)(cai)不受(shou)本條(tiao)第(di)一(yi)款規(gui)定(ding)的(de)仲(zhong)(zhong)(zhong)(zhong)裁(cai)(cai)(cai)時(shi)(shi)(shi)(shi)效(xiao)期(qi)(qi)間(jian)的(de)限制;但是,勞(lao)(lao)動關系終(zhong)止的(de),應(ying)當(dang)(dang)自(zi)勞(lao)(lao)動關系終(zhong)止之日(ri)起(qi)一(yi)年(nian)內(nei)提(ti)出(chu)。”
