什么情況下辭退員工要支付經濟補償?
問 我(wo)是(shi)一名機械(xie)工人(ren),在一家私企工作(zuo)四(si)年(nian)了,前(qian)段時間在工作(zuo)中受傷(shang)了,公(gong)司要和我(wo)接觸合(he)同,是(shi)不是(shi)應該給(gei)我(wo)一些經濟(ji)補償?
答 勞(lao)(lao)動(dong)合(he)同法(fa)》第(di)40條規(gui)定:在以下三種情形下,用(yong)人單(dan)位(wei)向(xiang)勞(lao)(lao)動(dong)者提出解除勞(lao)(lao)動(dong)合(he)同時(shi),應(ying)支付經(jing)濟補償金: (1)勞(lao)(lao)動(dong)者患(huan)病(bing)或者非因工(gong)(gong)負傷,在規(gui)定的(de)(de)醫療期滿后(hou)不(bu)(bu)能(neng)從(cong)事原工(gong)(gong)作(zuo),也不(bu)(bu)能(neng)從(cong)事由用(yong)人單(dan)位(wei)另行安排的(de)(de)工(gong)(gong)作(zuo)的(de)(de); (2)勞(lao)(lao)動(dong)者不(bu)(bu)能(neng)勝(sheng)任(ren)工(gong)(gong)作(zuo),經(jing)過培訓或者調整工(gong)(gong)作(zuo)崗位(wei),仍不(bu)(bu)能(neng)勝(sheng)任(ren)工(gong)(gong)作(zuo)的(de)(de); (3)勞(lao)(lao)動(dong)合(he)同訂立(li)時(shi)所依據的(de)(de)客觀情況發生重大變(bian)化,致(zhi)使勞(lao)(lao)動(dong)合(he)同無(wu)法(fa)履行,經(jing)用(yong)人單(dan)位(wei)與勞(lao)(lao)動(dong)者協商,未(wei)能(neng)就變(bian)更(geng)勞(lao)(lao)動(dong)合(he)同內容達成協議的(de)(de)。
