什么情況下辭退員工要支付經濟補償?

我是(shi)一名(ming)機械工(gong)(gong)人(ren),在一家私企(qi)工(gong)(gong)作(zuo)四年了,前段時間在工(gong)(gong)作(zuo)中受(shou)傷了,公司(si)要和我接觸合(he)同,是(shi)不是(shi)應該給我一些經濟補償?

勞(lao)(lao)動(dong)(dong)合(he)同(tong)(tong)法(fa)》第40條(tiao)規定:在以下三種(zhong)情(qing)形下,用(yong)人單(dan)(dan)位(wei)(wei)向勞(lao)(lao)動(dong)(dong)者(zhe)(zhe)提出解除勞(lao)(lao)動(dong)(dong)合(he)同(tong)(tong)時,應支付經(jing)濟補(bu)償(chang)金: (1)勞(lao)(lao)動(dong)(dong)者(zhe)(zhe)患(huan)病(bing)或者(zhe)(zhe)非因工負(fu)傷,在規定的(de)醫療期滿后不(bu)能從事原工作(zuo),也不(bu)能從事由用(yong)人單(dan)(dan)位(wei)(wei)另行(xing)安排的(de)工作(zuo)的(de); (2)勞(lao)(lao)動(dong)(dong)者(zhe)(zhe)不(bu)能勝任工作(zuo),經(jing)過培訓(xun)或者(zhe)(zhe)調整工作(zuo)崗位(wei)(wei),仍不(bu)能勝任工作(zuo)的(de); (3)勞(lao)(lao)動(dong)(dong)合(he)同(tong)(tong)訂立(li)時所(suo)依據(ju)的(de)客觀情(qing)況發生重大變化,致(zhi)使(shi)勞(lao)(lao)動(dong)(dong)合(he)同(tong)(tong)無法(fa)履行(xing),經(jing)用(yong)人單(dan)(dan)位(wei)(wei)與勞(lao)(lao)動(dong)(dong)者(zhe)(zhe)協(xie)商(shang),未能就變更勞(lao)(lao)動(dong)(dong)合(he)同(tong)(tong)內容達(da)成協(xie)議(yi)的(de)。
