員工有辭職自主權嗎?

我是一(yi)名機(ji)械工(gong)(gong)程師,現在(zai)在(zai)青島一(yi)家(jia)公司工(gong)(gong)作,由于家(jia)庭原因,我想辭(ci)職去濟南,員工(gong)(gong)有辭(ci)職自主權(quan)嗎?

《勞(lao)動(dong)(dong)(dong)(dong)合(he)(he)(he)同法》第37條規定(ding):勞(lao)動(dong)(dong)(dong)(dong)者(zhe)提(ti)前30日以書面形(xing)式(shi)(shi)通知用人單(dan)位,可以解(jie)除(chu)勞(lao)動(dong)(dong)(dong)(dong)合(he)(he)(he)同。 這里(li),勞(lao)動(dong)(dong)(dong)(dong)者(zhe)是否需(xu)要合(he)(he)(he)適的(de)理由沒有(you)明確(que)規定(ding)。也(ye)就是說,該條規定(ding)實際上確(que)認了(le)勞(lao)動(dong)(dong)(dong)(dong)者(zhe)合(he)(he)(he)法的(de)自主辭職權。勞(lao)動(dong)(dong)(dong)(dong)者(zhe)根據自身情況或者(zhe)個人發展需(xu)要,需(xu)要解(jie)除(chu)勞(lao)動(dong)(dong)(dong)(dong)合(he)(he)(he)同的(de),只要提(ti)前30日以書面形(xing)式(shi)(shi)通知用人單(dan)位,即可以解(jie)除(chu)勞(lao)動(dong)(dong)(dong)(dong)合(he)(he)(he)同。 但是,如(ru)果(guo)勞(lao)動(dong)(dong)(dong)(dong)者(zhe)因(yin)個人原因(yin)解(jie)除(chu)勞(lao)動(dong)(dong)(dong)(dong)合(he)(he)(he)同違(wei)反了(le)勞(lao)動(dong)(dong)(dong)(dong)合(he)(he)(he)同中的(de)相(xiang)(xiang)關約(yue)(yue)(yue)定(ding),構成違(wei)約(yue)(yue)(yue),則還應承擔相(xiang)(xiang)應的(de)違(wei)約(yue)(yue)(yue)責任(比如(ru)關于服務期的(de)約(yue)(yue)(yue)定(ding))。
