公司總是給放假,可以辭職嗎?

我(wo)是一(yi)名監理師,現在(zai)在(zai)山(shan)東(dong)濟(ji)寧工(gong)作(zuo),公司總是給放假,可(ke)以辭職嗎?

根據《勞(lao)動(dong)(dong)(dong)(dong)(dong)合(he)(he)同(tong)(tong)法(fa)》第38條(tiao)規定,單位未按照(zhao)勞(lao)動(dong)(dong)(dong)(dong)(dong)合(he)(he)同(tong)(tong)約(yue)定提供(gong)勞(lao)動(dong)(dong)(dong)(dong)(dong)保護或(huo)者(zhe)勞(lao)動(dong)(dong)(dong)(dong)(dong)條(tiao)件(jian)(jian)的,勞(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)可以(yi)解除勞(lao)動(dong)(dong)(dong)(dong)(dong)合(he)(he)同(tong)(tong)。 如果單位安排勞(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)工(gong)作(zuo)的環(huan)境(jing)和工(gong)作(zuo)條(tiao)件(jian)(jian)惡劣,存(cun)在安全(quan)隱患(huan)或(huo)漏洞,有可能給勞(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)的安全(quan)帶來威脅;或(huo)者(zhe)勞(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)的工(gong)作(zuo)環(huan)境(jing)與勞(lao)動(dong)(dong)(dong)(dong)(dong)合(he)(he)同(tong)(tong)約(yue)定的內容(rong)不符,勞(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)都可以(yi)以(yi)此理由提出解除勞(lao)動(dong)(dong)(dong)(dong)(dong)合(he)(he)同(tong)(tong)。 用人單位隨意(yi)強行給員(yuan)工(gong)“放假”或(huo)“停工(gong)”,無疑剝奪了勞(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)的工(gong)作(zuo)權利,讓勞(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)失去賴以(yi)工(gong)作(zuo)的基本(ben)條(tiao)件(jian)(jian),因(yin)此可視為(wei)未提供(gong)勞(lao)動(dong)(dong)(dong)(dong)(dong)條(tiao)件(jian)(jian)。
