公司總是給放假,可以辭職嗎?

我是(shi)一名監理師,現在在山東濟寧工作,公(gong)司總(zong)是(shi)給放假,可以辭職嗎?

根據《勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)(tong)法》第38條(tiao)規定,單位未按照勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)(tong)約定提(ti)供(gong)勞(lao)(lao)(lao)動(dong)(dong)(dong)保護或者(zhe)勞(lao)(lao)(lao)動(dong)(dong)(dong)條(tiao)件(jian)的,勞(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)可(ke)(ke)以解除(chu)勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)(tong)。 如果單位安排勞(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)工(gong)(gong)作(zuo)(zuo)(zuo)的環境和工(gong)(gong)作(zuo)(zuo)(zuo)條(tiao)件(jian)惡(e)劣,存在安全隱(yin)患或漏洞,有可(ke)(ke)能給勞(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)的安全帶來威(wei)脅(xie);或者(zhe)勞(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)的工(gong)(gong)作(zuo)(zuo)(zuo)環境與(yu)勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)(tong)約定的內容不符,勞(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)都可(ke)(ke)以以此(ci)理由(you)提(ti)出解除(chu)勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)(tong)。 用人單位隨(sui)意(yi)強行給員工(gong)(gong)“放假”或“停工(gong)(gong)”,無(wu)疑剝奪(duo)了勞(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)的工(gong)(gong)作(zuo)(zuo)(zuo)權利,讓勞(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)失(shi)去賴以工(gong)(gong)作(zuo)(zuo)(zuo)的基(ji)本條(tiao)件(jian),因此(ci)可(ke)(ke)視為(wei)未提(ti)供(gong)勞(lao)(lao)(lao)動(dong)(dong)(dong)條(tiao)件(jian)。
